We're losing well today honey, it's V for victory day, it's a w w, it's a serious victory. I love it, okay, so you have to tell us what happened. The list is at least temporarily, hopefully, dead or about to disappear, so tell me. details I think it's about to disappear, you know, the list for years has limited the ability for people to purchase a firearm that is appropriate for their individual needs because the list has been frozen for a decade, and then when they put me, it was very difficult to get a gun on the list and then they added, just to make it more difficult, they added a loaded chamber indicator requirement, a magazine disconnect requirement and then, just to make it impossible to get any more guns on the list. list, they added a micro stamping repository requirement. which no manufacturer could do, so the number of pistols that were available in a particular, pistols that were available in a gun cabinet of a retailer, went from a couple of thousand to basically about 200, there were a few different finishes and now you know, uh Coatings, but essentially you could choose from about 200 models of guns and that's obviously a lot less guns that are on the market, not only that the latest, greatest and safest guns couldn't be on the list. of pistols that could be sold in the state because they did not have Micro stamping or loaded chamber indicator or magazine disconnect, so Californians were being deprived of the latest, better and safer models of pistols, to be able to access them for a long time time.

The crpa and Michelle and Associates have long challenged this requirement using that rationing of the new Bruin evidence from the Bruin case that emerged from the United States Supreme Court last June and we sought a preliminary injunction in the district court of the United States and today we got our ruling on our injunction and the judge granted that injunction and determined that the listing, the requirements at least for the micro stamped charged chamber indicator and the charger disconnect were unconstitutional, so this It's a fantastic victory. Now the state is obviously going to appeal, but in the meantime, this is one of what I hope is a series of big victories for Post Brewing that overturns some of the useless and ill-conceived gun control laws that California has been pushing. our throats and the throats of law-abiding gun owners for decades, none of which make us safer, but all of which are designed to make it increasingly difficult to buy a gun, in this case, a gun from a particular size or with a particular grip or with a particular view represent different things that people needed for their individual circumstances that choice was eliminated and if we can preserve this victory on appeal unfortunately the fight is not over, but this is a great start. uh that all of those options, all of those guns, will be backed up in your local retailers, uh, display cases and you'll be able to get a gun that's right for you, so as a practical matter, right now there's a preliminary injunction, but the state is going to appeal.

Does that mean the law can't be enforced during appeal or how does that work? No, the judge gave him the status that he knew they were going to appeal, so he issued his injunction. Their court order would take effect in 14 days, although they will appeal. before that they will ask the 9th Circuit and they will have to object to the 9th Circuit granting it but they will ask it to stay its ruling while the case is litigated on appeal and they probably will given the 9th Circuit but depending on which judges we can respond that question, so this will be a fight from the beginning in the ninth circuit, but we are ready for it and if we continue to receive the support of the CRP people. keep donating to the crpa keep supporting this prpa during the crpa help us preserve this victory and a host of other victories that we hope will come soon in uh in uh background checks for ammunition on assault weapons in uh the uh lar the so - he called to the standard capacity magazine band, all of those decisions should be made at any time uh and we're anticipating good results on those as well and you're all sitting with Judge Benitez, right?

Yeah, yeah, so we can do this. It wasn't Judge Benitez, this was a different term, true, but we may have seen Judge Benitez's rulings before, so we can be relatively confident that they will go our way. I think with the others, yeah, I mean, the state obviously fights tooth and nail. This is a scorched Earth litigation that you know they don't fight any harder than this, but hold on to these, you know, Gavin Newsom's wish list of uh gun bans, uh, because this is his narrative, ya You know, he goes out and scares people and hates gun culture, as he calls it.
To me, those are my friends who respect the right to keep their guns, respect the freedom that comes with the Second Amendment, and want to be able to choose a firearm. the most effective tool to defend themselves and their families and for hunting and sport shooting and all other legal purposes. I mean, there are a lot of shooting sports in this state and the crpa is out there, promoting them too for women, disabled youth, shooters, we have all kinds. of different programs to get people out to the range, pull the triggers, have fun and discover how fun shooting sports can be, but for today at least we are on the way to restoring the right to get a gun that fits to your needs. your individual needs uh in the state of California, well, and I want to clarify, you know, by the way, I have my crpa hat on just a symbolic stand, but I want to clarify that this is not the victory, it is not a complete victory.
However, this is a big victory in the battle in the future because the state is going to appeal and the battle, you know, obviously we have to complete the case and finish it, but a few years ago, you know, before Bruin, it is possible If we hadn't gotten this far, we may have been dumped before we got that far, so this is a big step forward, isn't it a big step forward? I think it's one of the first post-crafting decisions and decisions on something so significant, huh? I know there is litigation over sensitive locations that was actually discussed today in the 2nd Circuit in the Antonic case.
There is litigation in Illinois over semi-autobanes and standard capacity magazine bands. There's Oregon and you know. Basically what has happened is since then all the losing legislatures in the blue states and the battleground states are trying to pass everything they can think of because they are vindictive, now they are angry about what the Supreme Court did . They don't like the Second Amendment, they don't want people to be able to choose to have a firearm and they are trying to red tape to red tape the right to death, which is why there are fights all over the country. uh, but this is, I think maybe the first big win, excuse me, and the tonic was important in upstate New York in sensitive places where your CCW is valid or not, uh, but I think this is the first big win. at least in California uh to uh to set the standard where it's supposed to be under Bruin instead of under the kind of balancing of interests test that they did where the state can say oh this will make us safer and the courts were like reluctant to question the state's wisdom on this, so a lot of things were confirmed, especially in the 9th Circuit, but I think this is the beginning or part of the beginning of a second amendment.
Consideration that the courts will have to reach an agreement. with and from what gun owners and second amendment supporters are going to benefit. Well, I know you know Chuck. I want to point out something that you've known for years that you and I have been saying, just as Rick and everyone else, we've all been saying it. Sam has been saying that as California advances, the rest of the nation advances and then California affects or infects the rest of the nation, but now guess what the anti-gunners have enjoyed about that fact for quite some time, but Now that's the other way around. your ear because now, as California moves forward, so does the rest of the nation, but in a very positive way, as we begin to tear them down, it won't set a precedent for the rest of the country, yes, and it's funny that there are states in several state legislatures. including Illinois, there were pending list bans and our list band is pending, so in this case now those legislative advocates from gun rights organizations will be able to go to those legislatures and say you can't pass this and use the authority what does it say.
That's right and we'll see what they do, they'll probably try to pass it anyway, but yeah, each one of these cases becomes a legal precedent for the next case, so we're looking at Antonak in New York as a precedent. to fight what California is going to try to do, you know, make it impossible to get a CCW and then if you get a permit to run a farm in public, they'll make you useless in so many quote-unquote sensitive areas that I can't cross. the city without breaking the law, but we can use that precedent. All this is a national precedent.
When you win in one state, you can use it in another state. If not like a binding authority, at least it is persuasive. Authority depends a lot on how well reasoned the opinions are, but so far so good when they faithfully apply Bruin uh and the test he laid out there, the historical analog test or the commonly used test, uh, we win. I want to ask. Do you have a question about that whole sensitive spot thing since I've had you because every time I teach a concealed carry course SB 918 comes up guys they killed it between you and the gun owners in California like California gun owners and Rick Travis. crpa let's take that down at two in the morning and take it down one vote by one vote and I just want to point out again the organizations that took it down because a lot of people want to take credit for that being Rick.
Travis from the California Rifle and Pistol Association and Sam Paredes from the governors of California, so if you're watching this in the capital in the early hours of the morning, now the legislature has retreaded that same bill and called it sb2 . but the difference, as I understand it, is that this time it is not an emergency provision, so an emergency provision if the governor signs it becomes a law like that, and they need two-thirds of the votes with one that does not It is an emergency provision. it doesn't need a two-thirds vote, but it doesn't become law until January of the following year, so if they pass it it doesn't become law until January 2024, and in the meantime you and your law firm are ready to take it down .
It is not like this? We have the lawsuit written for 918. We're just going to change the numbers the day Gavin Newsom signs this bill. We will withdraw our lawsuit and probably distribute it at his press conference. This is our future our children's future our freedoms our rights the style of government we are going to have there is a battle for the soul of America right now with the woke movement or the cancer culture and all that and the Second Amendment really is the tip of the spear the government historically governments have disarmed the people to the citizenry before they take more power and become tyrannical and it can happen, it happens, you know, it happens in modern times, so the Second Amendment is the ultimate check on that, there's a quote misattributed to George Washington who called someone one of the founding fathers of all the prongs of Second Amendment Freedom and that sums it up, there's something we haven't talked about regarding this thing we need or anything else that's happening.
In California, I think we're covered on the list, but keep your camera ready for when the next win comes, which will probably be any time now from San Diego District Court.
