FCC Law Enforcement - What Does The FCC Do If You Talk On A Ham Radio Or GMRS Without A License?

Mar 23, 2024
A very wise man once said how heavy the head is that eats crayons, today I am going to

talk

about the FCC that goes after people for breaking the rules by doing things like

talk

ing on

gmrs

channels with a baofeng uv5r or people talking over ham or

gmrs

frequencies without the proper

license

we have all heard stories that say something like this if you transmit on ham or gmrs frequencies without the proper

license

the fcc will triangulate your location and give you a fine of ten thousand dollars or if you use the wrong

radio

like the humble baofeng uv5r, who is a

radio

ham, if you use the wrong type of radio to transmit on gmrs frequencies, the fcc will come after you and put you in jail.

You can find these stories anywhere on the internet, on any online forum about ham radio or gmrs just google

what

will happen if I broadcast on ham radio without a license and you will see the stories, but telling these stories is like telling a 12 year old that If you don't stop

what

you're doing, you'll grow hair. in his palms, well, guess what, I don't have hair on my palms. I have mentioned these stories many times in previous videos and of course, being the polite gentleman that I am, I have never directly said that these are lies and I wouldn't do that, but I have explained several times that every time the FCC makes an

enforcement

of the By law, every time someone is imprisoned or found shooting their dog or executing it, the FCC is required to make that application public.

More Interesting Facts About,

fcc law enforcement what does the fcc do if you talk on a ham radio or gmrs without a license...

In fact, they have a database, the FCC Enforcement Database, that anyone can search on the Internet to see exactly who has gotten in trouble with the FCC and why, and if you search this public database of FCC compliance, you will find that I will reference. to my notes so as not to make any mistakes, you will find that the fcc has never gone after anyone simply for using a non-gmrs radio like the humble balfang uv-5r on gmrs frequencies and has never gone after anyone simply for talking on ham radio frequencies or gmrs frequencies without the proper license and every time I say any of these things in one of my videos, all the YouTube comment experts know they are experts because they almost always start their comment by saying "I".

I have been a ham radio operator for 20 years, it's not me that says it, that's what they say, so we know that everything they say must be true and correct, and they repeatedly mention the same two cases to prove their case, their story to prove his bogeyman stories. that the FCC actually goes after people who talk on ham radio or gmrs without the proper license or who use the wrong type of radio on gmrs. Now let me recap what I just said so we can be sure everyone is following us because I hate having to delete all the stupid comments from morons who aren't actually paying attention, so I'll recap and say it more slowly this time.

I have said many times in many videos that the FCC has not or at least has no citations in the past ever go after someone simply for talking on unlicensed ham radio or gmrs frequencies or simply for using the wrong type of radio e.g. a uv-5r on gmrs frequencies, and then the youtube comment experts show up and prove me wrong. They cite two cases where the FCC went after someone simply for using the wrong radio or talking on unlicensed Hammer GMR frequencies, and to prove their points, they sometimes even go as far as leaving links to the FCC database for these two in particular. cases they refer to for all of us to read, proving that the FCC is in fact going after people for simply talking without a license on their radio with their friends or using the wrong type of radio on gmrs now of course these People, like I said, are YouTube comment experts, so of course we should believe everything they say, but let me recap what these two cases are.
The first is the FCC case v. Mr. Kevin Bondi Bondi of Encino, California, and the FCC case see I. I'm looking at my notes, the FCC v. Mr. Fabrice Polyneice Polyneice Polyneice of North Miami, Florida . These are the cases that YouTube comment experts cite several times as proof that the FCC goes after people who simply aren't using the proper license. hammer gmrs or use the wrong radio two cases among all the millions of people who probably do this all the time two cases in the last 20 years so what exactly did these two people do mr kevin bondi from encino california and mr fabrice pollinis polineice palin from North Miami, Florida, what did they really do?
They allowed me to begin the FCC case against Mr. Kevin Bondi of Encino, California, just down the road from me. I'm reading my notes so I don't make any mistakes and irritate the YouTube experts. who love to come and leave comments every time someone on YouTube makes the slightest mistake starting in 2009, that is, the year 2009. Mr. Bondi was accused of intentionally interfering with a commercial licensee and intentionally and continually blocking his channel so I couldn't use it. If a commercial licensee is someone who pays money to the FCC to reserve a frequency that they can use to conduct their business and in 2011, that's a couple of years after the initial complaints and after many bad letters from the FCC, the FCC issued a 24,000 fine to Mr.
Kevin Bondi of Encino California now as of 2021 I don't think Mr. Bondi hasn't paid a dime to the FCC yet, but that

does

n't matter, maybe he did, maybe he didn't, no I know. Never mind that someone leaves a comment and gives us the full legal summary, it

does

n't matter, the point is that he was doing more than just talking to his friends without a ham license or gmrs or using the wrong type of radio. gmrs the other case is often cited as proof that the fcc will indeed go after people who use the wrong type of radio on gmrs or who don't have their gmrs or ham radio license and are talking to their friends. the other case is the curious case of mr fabrice pollinis polynice polonies and the brief summary of what mr polyneice polynice what mr fabrice was doing in 2012 after having operated a pirate radio station pirate radio station in his backyard for several years and after several contacts and many bad letters from the fcc the fcc finally got a court order and confiscated all of his pirate radio station's equipment almost as soon as the FCC vans drove away he got more pirate radio equipment and started his pirate radio station again, blah blah blah, more letters, more law

enforcement

and a few years later. many years later, the FCC finally issued a very large fine to Mr.
Polyness Polynice of Florida and Mr. Polyneice has ignored all of those fines. I believe as of 2021 he still hasn't paid a cent in fines and I also believe that I understand that he is still running his pirate radio station in North Miami, Florida, he could be wrong. All these self-proclaimed legal experts on YouTube will clarify it for us in the comments, but it doesn't matter because Mr. Polyneice was also doing a little more than just talking to his friends without a license or using the wrong type of radio on gmrs, which is what claimed all the self proclaimed legal radio experts on youtube, remember the bogeyman story says that if you use the wrong type of radio on gmrs like a uv5r or talk on gmrs or unlicensed ham radio the bogeyman will come get you on none of the cases cited by those same experts are even close to what happened, I don't even think they read the actual FCC complaints, so anyone.
I still don't understand what all these stories we've heard so many times about what the FCC will do or just talking to your friends without the proper license or using the wrong radio mean. All of these stories are the FCC based on your past history which is available to the public on the Internet in their law enforcement database based on your past history the FCC doesn't care about this kind of stuff. The FCC has much more important things to do, like stopping all those robocallers that everyone gets all the time. great job FCC now I'm not advocating that we all go out and break the rules.
I'm not advocating that anyone break the rules. Rules are what separate us from the savages. We must all follow the rules. It's the right thing to do what I am. defend is that some people stop telling all these stories because they are lies and honestly I am tired of removing these stupid comments from my channel if you have an example of someone who got in trouble with the FCC simply for not using a license. or talking to your friends on gmrs with the wrong type of radio or no license, please leave a comment below but make sure you leave a link to the source of your information because without a valid source we know you are just making up another man story coat.
If you have questions about these cases, please leave a comment below. I'm not a lawyer so I won't answer them, but don't worry, a YouTube comment expert will come and be happy to make up more lies and answer them for you.
