I also just want to say that if you're interested in this case, there's a great podcast called Your Own Patio Podcast.
It was made by Chris Lambert and is so well done that he interviewed many of them. of people there is so much new information, a lot of new information actually comes from this podcast that has been re-reported. This podcast played a huge role in what happened recently. I'll explain more, so I just want to say hello and say definitely. Go watch it, download it and rate it if you can, so let's start with Kristen's past and her upbringing. Now this case is often confused with the clever Elizabeth case that I have also covered. I'll link it below.
This is a completely different case. There is no relationship between Elizabeth and Kristen Smart, they only share the last name, so Kristen Denise Smart was born on February 20, 1977 in Augsburg, Bavaria, West Germany, these are her parents, Denise and Stan Smart, they are really calm people and with down to earth, and I actually worked as teachers for children of American military personnel, so they stayed overseas for three

years

and then came back to the US, so Kristin was born while they were gone and they were They were really excited and surprised when they had Kristin because they didn't think they could conceive, I'm not sure exactly why, but she was a surprise to them and they were very happy.
While she was growing up, Kristin was described as an exceptional student, a very brave, motivated and, according to her parents, child. she was a truly exceptional child, she was learning to walk and talk very quickly, she was very motivated and full of life from a young age, she even spoke early and as a baby she learned super fast and generally excelled in October 1979 Stan and Denise had another child that they were excited about, you know, they didn't think they could have one and now they had two and then they had another one in 1982, a daughter, so now they had their son Matthew, their daughter Lindsay and Kristen.
The family was complete, they ended up deciding to settle in Stockton, California, to raise their family. this is a really beautiful area i mean it's california most of it is beautiful and

kristin

was described as a very involved older sister she loved her younger brothers and loved being a big sister she was fun she played with them she wasn't afraid to pass time with them she was not spoiled and just wanted to be with her friends she loved being with her brothers and they loved her too kristen was she was a good student she worked very hard in school she had ADHD and that sometimes presented challenges but she didn't let That didn't stop her at all, she really loved being active, especially anything that involved water, she loved swimming, surfing, she loved the ocean.
She also played soccer and also participated in school plays, something she also enjoyed. Finally, when she was old enough, she started babysitting and that was something she really loved because she really liked being around children. She had a very playful heart. and so the kids liked her because she really played with them, did little skits with them, dyed shirts, different art projects, crafts and whatever, and the parents obviously really liked her too because she was really interested in being with the kids. and she wasn't just there to raise money and oversee her growth, Kristen wasn't very popular, but she had some good friends, she had met people through girl scouts, people from her neighborhood and from school sports like that, and she always gave welcoming people to her home she loved inviting people over and her parents were really willing to have someone there whenever she was or even bring people on vacation they were just a really great family that was very loving and accepting of everyone, Kristin dreamed of converting one day.
She was an architect because she was actually very good at drawing and one thing she loved to draw were houseplants as very detailed versions of them on graph paper. She had a real natural talent for this, so she definitely had a bright future ahead of her. She had always been interested in architecture, but at another time she might tell you that she wanted to be Joan London and have the opportunity to interview lots of interesting people and travel the world. No one could tell him that nothing was impossible by the end of high school. At school she had some opportunities to travel and had a very adventurous spirit, so she was totally up for going.
First she spent a summer in London with the family of one of her friends and then she spent another summer in Venezuela as an exchange student in her third year. She decided to go to high school at a school in Napa that was quite far from where she lived, but her dad was the principal and he went a lot because he had to travel quite far and she wanted to see him more, so her plan was to go to school. and hopefully they would spend more time together, so she transferred and they also ended up moving around a bit like they had some life changes, so it was a harder year for Kristin, less stable than normal, not her.
She had so many friends and she just felt sad, so in her senior year she returned to Stockton, where most of her friends went to school and she was happy to graduate there. Kristen graduated from it in 1995. There is this beautiful photo of her. I think this is my favorite photo of her because she looks so genuinely happy that summer. Kristen wanted to spend as much time as she could at the beach. She spent most of her time at a local beach called Shell Beach, but she wanted to branch out and see other beaches. in the world, so she ended up deciding to apply to be a lifeguard and camp counselor at Camp Mokulaia.
I hope I said it right, but this is a beautiful campground in Hawaii. I'm sure you can imagine it. Here's a photo of her at Camp. She had a lot of fun that summer, met a lot of people and became very close to this girl, a co-counselor named Rachel Bird, and the two of them worked together with the younger kids at camp, so Kristen loved Ocean Kids. Hawaii, I mean perfect situation, now he has good friends there. She was very happy that summer. That summer, Rachel's cousin died while they were at camp and she was very close to her cousin, so she was totally heartbroken and Kristen was one person she was.
He really was there for her during this time, she said she was very grateful to be around her. There's actually an interview with Rachel on the Your Own Backyard podcast if you want to listen to it, so because Kristen is such an adventurous person, you'd assume she might go to college, but she actually wanted to stay close to home, she was very close. to her parents and wanted to be able to get to them quickly if necessary, but she was still independent and told her mom that even though she was going to be close, she wasn't going to call her all the time, you know, she would still talk to her, but There was going to be some separation, she was really going to move into the adult world that Kristen had also taken on. some courses at the local community college to get into a better four-year program and was finally accepted to UC Santa Barbara, but she had already accepted and made a deposit for a dorm at California Polytechnic State University, or Cal Poly, that is in San Luis Obispo California, so instead of pursuing architecture, Kristin changed her mind before she started college and went into communications because she eventually wanted to travel the world as a journalist and had actually enrolled late at Cal Poly, so he had to live. in the off-campus apartments, which discouraged her a little bit because you know you want the freshman campus experience to be right there on campus, that year during Christmas break she went and visited her friends in Hawaii, she She had a great time with them and when she returned, a dorm had opened up on campus, so she was excited.
She moved to room 120 in Muir Hall in an area called Red Bricks. She was very happy about this. She was going to be able to walk to her classes. Walk to different things on campus very easily, it will give you a more social scene. You know, her roommate that she lived with off campus was nice, but she was a little shy and not very social. Kristen wanted to have more experience like her. She wanted to go to parties, she was a very social person, so this was going to be the beginning of her real college experience for her and Kristen was on this whole journey in college to really discover her identity, like so many of us do in college. college during This time she was giving herself different nicknames, she dyed her blonde hair brown, she was just having a lot of fun and Kristen drank socially, but she wasn't a big drinker, for her it was much more about the social aspect during this time, Kristen .
He was working as a lifeguard at the Cal Poly pool and worked the 5 a.m. shift, so he usually had to get up at 4:30 most mornings, but he didn't really care, he loved the water and during the school was definitely experiencing independence, but she called her parents oncea week on Sundays and communicated and that spring her parents visited her several times and one of the times Kristen told her mom that she was just having a hard time at school, that it was hard to keep up with her classes. They overwhelmed her, she felt like she never had enough time for anything other than going to school and that she was tired all the time, so she felt like she needed a change.
In fact, he told his mom that he thought it would be better if he went to school somewhere like the Virgin Islands or Puerto Rico where he could be closer to the beach and have a more relaxed college experience. At one point, the Things got so bad that she practically begged her mother to let her drop out of school, and as supportive as her mother is, she obviously wanted her to finish what she'd started. She worked so hard to get into school that he wanted her to do it. She graduated and also it was her her first year her mother felt that maybe she just needed a little more time to adjust.
In early May 1996, Denise wrote Kristen a letter encouraging her to stay in school, encouraging her to continue working hard and persevere. She also told him that maybe she should quit her lifeguard job and focus on what's important until Memorial Day weekend rolls around. Memorial Day Weekend 1996. That Friday, May 24, Kristen called her parents and left a message on their answering machine and the message was Good news, good news, I'll call you Sunday, so Kristen had a friend at school who was very close, her name is Margarita Campos and they both had ADHD, so they really connected over this and fought during the first year and that night.
Kristen wanted to go out with Margarita and go to some parties. You know, towards the end of the year, she's starting to relax and get ready for summer, but Margaret said that she was tired and that she really just wanted to stay home, but Kristen really wanted to. To get out of it, she didn't like going out alone, so he begged her to go with her. Finally she agreed and they went out just looking for a party, but it was Memorial Day weekend, so they don't normally have that many parties. Much of the campus is cleared on holiday weekends and Kristen had recently lost her dorm key so they only had margaritas to return to the building and Kristen also didn't have her ID or her wallet that night, she didn't actually drive . herself so she just hung out with people who did have one, she didn't even have a driver's license, it didn't seem to be something that interested her so they got ready that night and when they went out they met another group of girls who accompanied them and went to look for parties, the group ended up getting a guy to take them and he was like a friend of theirs and they went to another party at another friend's house and it was just Lame Kristen said she was actually a failure and she wanted to find something more exciting to start with on the weekend while he was there he just had one beer and then they continued looking for more parties so they just drove by this guy's house. truck looking for more parties and when they didn't see anything, Kristin and Margarita got off in this neighborhood hoping they would know they had stumbled upon a house party, but after walking around for a bit, Margarita was tired and didn't want to go. came out first, so she said to Kristen, you know, hey, let's go back and Kristen wasn't happy, she really wanted to have a good time that night, for some reason, that weekend she was really determined to have fun and Margarita finally she said hey you can go on I'm going back home and they decided to break up and to this day Margarita feels really bad about it because she said she was raised as a girl scout she knows the friend system and feels like she should never have left to Kristen that night and I can't imagine how hard it would be to have that guilt on your shoulders, you know, so the two of them had gotten into a little fight over this, it wasn't really an argument, it was just that Kristen seemed upset.
Because of all this, they were a little upset with each other, so Marguerita simply gave Kristen the key to her room so she could get in that night. Kristen put it in her sock and continued walking and Margarita went in the opposite direction, that was the last time she saw her, so around 10 p.m. m., about a tenth of a mile from where he dropped off Margarita, he found a party and it was actually a birthday party at a frat house, a sigma chi house, an unofficial house, it was for a guy named Ryan Fall who it was for swampy and it wasn't really a big party, about 20 people were invited and people kept coming and going and according to the people who were there, all the guys seemed very interested in Kristen right away, she looked beautiful , she's tall, she was wearing these vinyl shorts, crop top and red Puma sneakers during the party, Kristen walked up to a guy named Trevor Bolter and told him her name was Roxy and she took him to the bathroom and he was so excited because he thought that She wanted to flirt with him. but when they entered the bathroom, she said that she was only interested in this basketball player who was also at the party that same night.
She apparently flirted with the basketball player, but he ignored her and she ended up drinking a lot that night. much more than usual, not sure why, according to Trevor, when he saw her later that night, she was really drunk, so the party ended around 2am and two of the people who were there that night , Tim Davis and Cheryl Anderson, were walking home from the party when they found Kristin Smart lying in the grass right outside on someone's lawn, so clearly she is very intoxicated that they try to help her up and she can barely walk, she barely has any idea what is happening, so they decided to take her back home. make sure she comes back safely and as they walk another student catches up to them, 19 year old Paul Flores, and he was acting like this super nice hero guy came up and put his hand around her bare waist and like He knows her but he doesn't know her, then he said that she was freezing during that time and that's why he was hugging her to keep her warm.
He said Kristen was hugging him as they walked and that the dorms were about a half mile away. away from where they are, which is hard when you're drunk, you can barely move. Paul lived in Santa Lucia Hall, which is very close to where Kristen lived in Muir Hall, so Tim Cheryl, Paul and Kristen are walking back to the dorms. He is the first to separate from the group. He had his car parked quite close and will drive the rest of the way, so the three of them kept walking. Cheryl lived in the Sierra Madre hall, which is at a different address. from the red bricks so obviously she's cold and uncomfortable too and wants to get home so she thinks Paul has it from here so she separates from them and goes to her bedroom and then Paul and Kristen continue walking towards the Red bricks.
Paul claimed that he continued to walk Kristen to her building and then watched her walk towards her building from his which is about 40 yards away and then after seeing her safely enter her bedroom he walked into hers and that was all at night, but that night. Kristen was supposed to spend the night in Margarita's room but she never showed up so Kristen had a roommate named Crystal and she was out of town that Friday night but she came back Saturday morning and when she came back to the bedroom he noticed Kristen's backpack. He was in bed but Kristen wasn't there, however, in college you know people sleep in all kinds of random places, you don't always think that something bad has happened to someone, so he assumed she would come back later, but Saturday night he didn't.
She didn't show up and she didn't show up on Sunday either so Crystal started getting worried and she talked to Margarita who was getting worried too so they started asking around campus to see if anyone had seen Kristin, heard of Kristen but no one There was So, obviously, when she never called her parents that day, they were really worried, but they knew that she was discovering her independence, they didn't want to bother her on any other Sunday, you would have called, but because it was a long weekend. The assumption was that she would call on Monday, so on Monday morning a group of her friends got together and talked about what they should do and finally decided that they should call the police.
It was her friend Jennifer Phipps who actually called the police. campus police and reported her missing, but they didn't actually accept the report, they suggested that Kristen had just gone somewhere for a weekend getaway for Memorial Day, they thought she would be back soon, they even suggested that maybe She went to Hawaii for the weekend since she loved Hawaii so much that Jennifer thought, "Maybe this is just the campus police. Let me call the local police and see if they react differently, but they didn't. It didn't seem like They didn't care or have any sense of urgency about Kristen.
Kristin had basically disappeared from campus, she didn't have her ID in her wallet, no money or credit cards and she didn't pack any of her things, she didn't bring any clothes, not a bag, none of their textbooks, nothing more. They did everything they could to convince the campus police to take the report, but they just wouldn't, so they called Kristen's parents to see if she was there and this really scared Kristen. Kristen's mom, it was a Cal Poly police officer who called. say that they had some concerns about Kristen and that she had returned home for the weekend and that's when your mother's instinct kicks in and you say this isn't right, your heart is broken but you can't let your will be broken. because you have to be alert and you have to look for resources that can help you find your daughter, but the police ended up assuring her that you know that students take spontaneous trips all the time, we even have this theory that she could have gone to Hawaii, They tried to calm her down.
Denise that Kristen was probably just traveling or with friends and would be in touch soon that she simply forgot her responsibilities to verify that her parents felt she wasn't Kristen at all, they knew this simply couldn't be true, Kristen would never do it. she just left without telling them where she was going or at least telling a friend, so it wasn't until May 28 that the police decided to file a report for Kristen and the campus newspaper didn't even acknowledge the report until that Friday in May . 31 and right now her parents are freaking out, they know Kristen didn't leave, she definitely didn't go voluntarily, so Stan decided to drive there and talk to the police and also physically put up flyers around campus.
He and Denise were already feeling like they were. on their own like the police just weren't going to do anything and they were so frustrated that it took so long to even file a report because they just wasted investigation time and we all know that the first 48 hours that someone goes missing are the most crucial and you have a less and less chance of finding someone as the hours go by and they just weren't doing anything and we don't really know why, but eventually they realized they had to do an investigation, so the campus police The investigation began and Obviously, this is a huge case for the campus police, so the San Luis Obispo police also intervened and worked alongside them at the beginning, they began by interviewing a group of witnesses who were at the parties at the that Kristen went out that night and tried to cheat on you.
They know how to build a timeline of who they talked to and what that night was really like and after interviewing several people, it became clear that there was one person of interest that really stood out to them and that was Paul Flores, Tim Davis, the other guy He walked Kristen halfway to her bedroom and said that when they were at the party she heard a loud noise and looked and saw Kristen on the floor with Paul Flores on top of her, almost as if they had fallen together or he was holding her. I would have pushed. and jumped on top of her, which was just weird and he remembered feeling really weird about it at the time and then that guy, Trevor, the one who Kristen pushed aside to go into the bathroom, also had an interesting experience with Paul that night. when he was in the bathroom.
With Kristen at one point she told him to leave because she had finished talking to him about the other guy and when he came out of the bathroom, Paul Flores was standing outside the bathroom door and started questioning him about what had just happened there with him. Kristen. He seemed very angry at first and he got scared and thought, "You know, maybe he's her boyfriend or something and he's going to beat me up, but as soon as he said nothing happened, the man Paul completely changed his demeanor and said: "No, don't worry." and as she laughed and trevor just thought that was very strange and then another student at the party said that when she was alone with paul he tried to kiss her she said that the first time he tried to do it she She pushed and tried to return to the party, but then he followed her back to where she was and did it again.again, so she pushed him again and then he tried to stay with her friend to protect herself and several students that night at the party said that paul tried to grope them, kiss them, that he was flirting with all these people and refusing to take no for an answer , even when they said they had a boyfriend or weren't interested, he was just being a general creep, that girl Cheryl Anderson, actually.
She had known Paul since before that night and his friends actually refer to him as Chester the bully so that says a lot and Cheryl said that on the way home, Paul kept trying to get her to leave and get away from them Like he kept saying, "Hey, go ahead." of us, you know, because they were walking pretty slow, Kristen had drunk a lot and Cheryl was cold and wanted to go home, so he kept telling her to keep walking ahead of them, but she didn't want to leave Kristen alone with him and neither did she.
She wanted to walk alone and before separating from them, while Paul was still holding Kristen's waist, he tried to kiss Cheryl and she said no, but he asked her for a kiss on the cheek. that and after this even though she was nervous she went home and left kristen with paul so of course the campus police decide to interview paul and they do it several times and he claimed he ended up at the party randomly That night he was just drinking a few beers and then decided to walk to his sister's house, but he saw a party on the way and changed his plans.
Police asked him if he had called his sister before he left that night and he said no, but he called. The records showed that he actually called his sister at 8 59. Paul said he remembered seeing Roxy, which was Kristen's name that night at the party and said that she was very flirtatious with all the guys, but he affirmed. that he didn't interact with her at all until they walked home and that he just helped her get to her bedroom and then went back to his, but that goes against what Tim said, he said that he saw Paul on top of her in the En the ground, he doesn't know if he pushed her or if they fell together.
You know, that's still a big mystery, but he claims that Paul talked to Kristin before walking home, so when police interviewed Paul, they noticed that he had multiple injuries. scratches on the back of the carpet that burned his knees and a black eye and Paul said the black eye was actually from a basketball game. He said it just happened that Sunday that his friend had elbowed him in the face, but then they left. and I interviewed a friend that he played basketball with and he said that Paul had a black eye before he even played and when he asked Paul how he got it he said he didn't remember it so the police confronted him with this lie and Paul said The reason he lied was because he didn't want anyone to know the real reason for his accident because he was a little embarrassed about it.
He said he actually hit his eye on the steering wheel of his truck. He was installing a stereo system. and somehow, while he's installing this new stereo system, he hits his eye on the steering wheel. He had now hit his right eye and is also 5 10, so it seems pretty impossible to hit your eye like that and it doesn't explain everything else. injuries and although the police thought it was strange, they decided not to take any photos to document his injuries. I don't know why a few months earlier, this Paul was arrested for driving without a license, which violated the probation he had been on from the previous year.
I will explain the charges and he decided not to appear in court, so the police obtained an arrest warrant for him. He was booked on May 27, 1996, just after Kristen disappeared, but before campus police took the missing person's report, this mugshot is. the only evidence of the black eye and it is still very difficult to see that he was practically cured at that time, but this is all we have when he was interviewed on June 19. Paul was very anxious and he just wanted to leave all the time he said that. he had somewhere he needed to be and the officer asked him twice where he needed to go before Paul responded that he had to go clean some concrete when the officer asked him where he said my mom's house was so I'm I'm sure some of you already are.
Putting together a picture of what has happened here now to add to this picture, Paul has a history of violence and inappropriate behavior with women for almost his entire life. When he was in eighth grade, he got angry and actually hit this other kid. hit his head so violently that he ended up in the hospital for a long time, so Paul's parents had to pay all of this child's medical bills at the time and remember this was in 8th grade, the court recommended control out of anger for him and his parents actually refused, they didn't think he needed it.
There is also a long list of people who have had strange interactions with Paul over the years, so many people simply describe him as strange, slightly aggressive and the main one that people seem to use is just plain creepy. Women have reported being harassed by him, harassed by him, or have simply reported some kind of creepy exchange with him. Many women called him a psychopath or scary Paul, so he definitely had a bad reputation and Paul didn't have any close relationships either. friends, he stayed with other groups of friends, but he was always that guy that no one wanted around, you know, he had a habit of showing up at parties uninvited, making everyone feel weird, he often got kicked out and when he worked at En su part-time job, I often groped other coworkers and thought it was fun to do this because they liked it.
It was so weird that he sometimes even followed people home and it seems like that once. He went to college and things got even worse in December 1995. He climbed up the side of an apartment to look into a window in the middle of the night. A woman who lived there saw him. She called the police and when they arrived they told him to get off. and told him to leave so it was like he hadn't gotten into any trouble a few months later three different women who lived in that building claimed that they were being harassed and that paul was calling them repeatedly all the time and that he wouldn't let them in peace, it was scaring them, but nothing was ever done with Paul, no one investigated the matter further during the first part of the investigation, Kristen's parents weren't really told anything, they had no idea, you know what was really happening.
If something was being done and it was really stressing them out, they said they felt like Kristen's case was being treated more like a missing bike than a missing person and they were also very upset with the incident report that came out on May 31 about the case. of Kristen was bad after interviewing several people at the party, the officer noted that Kristen was very drunk and was flirting with a group of men at the party and in fact wrote in her notes that she lives her way, not according to the typical teenager. behavior and noted that these things did not imply that her behavior caused her disappearance, but she did know that they provide a snapshot of her behavior on the night of her disappearance, basically the victim immediately passive aggressively shames her by saying that this is somehow Kristen way. guilt and then on June 20, an investigator spoke to the school newspaper and was quoted as saying that there is no evidence of criminal activity, it does not appear that she was the victim of a crime, so we are handling this case as a adult missing under unusual circumstances, luckily the campus police weren't in charge of things for long, which they really shouldn't have been handling this from the beginning, but on June 26, 1996 they turned him over to the sheriff's department San Luis Obispo County and in three days.
They organized a campus search that included over 400 volunteers, helicopters, dogs, all things that would have been very helpful to have her when she first disappeared. Meanwhile, until the mystery is solved, Roxy's classmates say they won't take her safety for granted. She makes me be cautious when walking at night and what I mean is I really can't believe it. It does not look real. She used to tell a friend to go back to her bedroom alone. You know nothing is going to happen, but now it's like. I won't leave her anymore we saw her on Saturday and Friday night before she disappeared she was standing on the corner and that's very strange that we see her and people wonder what happened to her, they brought the dogs to campus, they walked them throughout the bedrooms and the handlers were not told any details of the case or where to look specifically so that they could not influence the dogs in any way, so four dogs ended up picking something up outside. from room 128 in Santa Lucía Hall, which turns out to be Paul Flores' room, which he shared with another roommate named Derek Say and when the campus police searched his room, he had already left for the summer and the janitor found him. cleaned, so who knows. what they might have missed, they literally cleaned all the sheets on his bed, all you know, of course they do it when someone leaves a bedroom, but when the dogs came into the room, they still hit Paul's mattress, investigators They actually removed the mattress and box spring. of the room let the dogs back in and they still detected something on Paul's bed frame and not only that, they also detected the same smell on a phone and in a trash can in the room, so the investigators They took that trash can and placed it in the hallway with a bunch of other random trash cans from other rooms and the dogs still identified the smell in Paul's trash can, so a little more about his roommate, Derek said he was out of town that weekend and when he came back, Paul told him.
He told him that he had walked Kristen back home that night and at that point Derek said that he jokingly asked Paul what you did with her, which I really don't understand how that's a joke, but anyway Paul responded and said that She was at my house having lunch. with my mom and that's important, remember that later on, when Paul wasn't at school, he stayed at his dad's house most of the time. His father's name is Rubén. His mother Susan was not staying there at the time because she had filed a legal claim. He separated from her in April, but sometimes she would stay there for several nights in a row.
Finally, on July 22, 1996, police served a search warrant on Rubin's home. They waited a week after receiving the order to deliver it, I don't know why, and they did the same. It's a half job with this search, I mean they didn't really bring in any cadaver dogs, they didn't even bring in a forensic team and they didn't search any vehicles while they were there, it was just an inspection, a visual inspection to see. Reuben has an avocado farm on his property, it's between one and two acres and they never looked. The most important thing they found while they were there were newspaper clippings about Kristen's disappearance. which is weird and they were in all random parts of the house, one was in the kitchen, one was in Ruben's room under his mattress and one was under Paul's mattress and pretty much from the beginning Ruben and Susan were very , very superficial about everything that a woman is. who worked with Susan said that she remembers that she was completely angry about everything that I worked with her and shared with me that Reuben in the middle of the night had received a phone call and he, you know, left and she was very disconcerted.
Because of that and the week after Kristen disappeared, Susan told her that she was really upset with Reuben because he had to take this late night phone call on memorial weekend and then he just left and she was frustrated because he didn't. I knew what it was. and she felt like maybe he was hiding something from her, so it seemed like if he was involved he didn't tell her anything, but they ended up searching Susan's house several times as if it said she wasn't staying with Reuben, actually she was. she lived in her rental property on East Branch Street, but during the first search the police actually didn't know they just assumed she lived with Reuben full time, so when Paul told the police he had to go deal with the concrete at her mother's house, no one even made the connection that she was talking about a completely different location, not Reuben's house, so August Susan ends up putting her house up for rent and it was rented by Mary and Joe Lasseter and their six-year-old son and they moved there.
On October 1st, Mary's mother lived next door and the three adults worked at the local hospital, so they would carpool together, it was a perfect situation, but just as they moved in, Susan is told by the owner that there is a aluminum trash can outside and you just shouldn't touch it, don't throw anything inside and someone will pick it up. Mary remembers thinking this was strange, it's just a trash can, why do you have such specific rules about it and why are you so afraid of us touching it? and then Reuben came and picked up that jar oftrash the next day so that next month Mary and Joe are at this new rental property and they start receiving mail from random people and it clearly wasn't directed at them, they were threatening messages saying, go ahead, come. talk to the police be honest about what your son has done you know what your son has done and at first they were confused but they started investigating everything and decided it would be better if they kept all this mail so they created a file special.
Then one day Mary was outside cleaning her car when she noticed something shiny near her front tire and it was an earring, as she describes it, a silver earring with a turquoise stone on the front and then it also had a fingerprint on it. dark reddish. It had a stain on the back, so she decided to put it in a little bag and put it away. She was

smart

enough to know that that was probably related to the letters people were sending. Then in October the investigators came to talk to them at their house and Mary wasn't there at the time, only Joe was there and he had mentioned, you know, my wife found this earring and they asked him if they could keep it, he said yes. , so they took it as evidence, at least they thought the detective's name had never been released, but this guy apparently took the earring and brought it to the sheriff's department and put it in a safe place, so as soon as The local police department took over the case, Paul Flores stopped cooperating completely in October of that year, investigators called a grand jury. not for an accusation, but just so they could do an interrogation for paul flores.
They wanted the witness testimonies, you know, to be documented under oath. They called Paul, his parents, her sister, Melinda, and her husband, Brett, and then made a statement in November. On the 14th, 1997 and during this time, Paul refused to answer any questions, even refusing to verify the names of his own family. His lawyers literally told him to just cite the fifth amendment after every question, every question, what is the address of your president, resident president, on the advice of my lawyer, I refuse to answer that question based on the fifth amendment of the constitution of the united states, are you under the influence of any medication that at this time could interfere with your ability to give clear and accurate testimony today on the advice of my attorney?
Answer that question based on the Fifth Amendment to the United States Constitution. You reported your Nissan truck stolen in San Diego recently. It is that correct, following the advice of my lawyer. I refuse to answer that question based on the Fifth Amendment to the United States Constitution. Rubén also made a statement. but he could not plead the fifth, so he answered the questions well: his son was a minor at the time a person filed a claim against him for damages in a civil action. I'm not sure I believe there was an agreement, but I'm not sure he was giving very conflicting answers, especially about the family's vehicles, so they had a Nissan and a Ford Ranger, but he said Paul never drove the Nissan, but all his co-workers confirmed that it was.
He also said no one had driven. access to the ranger, that may be, but that was also a lie and of course the flores family no longer owned any of the trucks they had traded in the ranger and then ownership of the nissan was transferred to paul, but in reality was stolen right before the statement and then that fall, Paul tried to enlist in the Navy so he could essentially flee the situation, but the smart family decided to file a 40 million wrongful death lawsuit against him so he couldn't leave anymore. Later, they tried to add lime.
Poli to this suit also for not protecting Kristin, but the university had immunity as a government entity. Fortunately, Paul ended up getting rejected from the navy and because of the lawsuit they were able to subpoena him and a few other people, including other students who walked home with them that night, some of Paul's coworkers, and even tenants who lived in Susan's house and they definitely had a lot to say, so the deposition started in January 1997. And what was really strange is Tim Davis who had also walked with Kristin home that night didn't show up and they called him and he basically scolded to the family's clever lawyer and they never spoke to him again Cheryl Anderson, the other person who walked home with them that night really had nothing new to say except that she didn't think Tim was involved at all, but when they interviewed the tenants, Mary and Joe, the smart family was surprised to find out about this earring, no one had ever told them that an earring had been found and of course this.
It's potentially huge evidence that they definitely should have been notified about, so of course their lawyer asked them to look at it, possibly identify the earrings and see if they really belonged to Kristin, but they never heard back for over a month, so they finally stayed. and Denise just decided to go to the police department and demand to see this earring and when they did they discovered that the earring was missing, someone had literally put the earring in a desk drawer, closed it, forgotten about it and they just lost it. At least that was their story, they were told that the police did a visual inspection of the earring and decided it was not related to the case, so years later, Mary ended up purchasing a pair of earrings that she claimed were almost identical to that.
What she found here is a photo of the earring which we definitely can't prove it actually looked like that, but if Mary is telling the truth and remembers it correctly, the crazy thing is that if you look at the missing photo of Kristin, it actually matches the necklace that she is wearing it, so it definitely could have been hers, but researchers claim that Mary's description and memory of the earring are incorrect. They claim that the earring that was found does not match the necklace at all, but there is no way to determine this because they lost it. but Mary had something even bigger than the earring, so in her backyard along one of the walls of her house were four flower pots, three were small ones about a foot in diameter each way and the fourth was much larger. large about six feet long and three feet wide. a photo of them in front of the boxes now Joe had tried growing flowers in this box but they kept dying, he thought it was very strange, he was normally pretty good at growing things so when he inspected the pot he realized that there was actually a layer of cement under the ground, that's why the roots didn't really grow.
They thought this was really strange for a flower pot so they asked a neighbor about it and the neighbor said that the flower pots were added in the summer of 1996, the same year Kristen disappeared, in fact it seemed like there was a lot of construction going on. house that year and then when they moved into Susan's house they started hearing a strange sound every morning around 4:20 a.m. they heard the sound. of an alarm clock that went off one night when Mary's mother was staying over, they went outside and tried to figure out where the sound was coming from.
They were literally crawling on the ground trying to see if they could hear him through the bushes buried in the grass. but they were never able to find out where this beeping was coming from and over time the beeping finally stopped. Mary thought it was definitely a clock, it really sounded like a clock, so she thought the battery must have died and she thought that was really strange. It's time to set an alarm for 420, I mean, it's pretty early, but Kristen was a lifeguard and she had to be at the pool at five. It's very possible that she set the alarm for 4:20.
So after Susan Flores found out that Mary and Joe had made the statement against her, she was angry and she retaliated by kicking them out of her house, who at that point were more than happy to leave, so by law they were 30 days to evacuate, so they were going to use this time to bring in some experts. To search the property on March 3, 1997, a geologist came in and did a sweep of the backyard and they also brought in cadaver dogs and actually alerted to an area in the backyard where the aluminum trash can had been and when The geologist looked in the backyard and said there were some anomalies in the ground, but he couldn't tell if they were natural or not because he had never actually personally looked for a body before, but he did notice that there were several broken pieces of concrete everywhere. in the backyard and there were also stains on the side of the house that looked like dirt had built up there, like someone was burying something and like I said, the neighbors had come over and said there was a lot of work going on there. backyard after kristen. disappeared in 1996.
A neighbor across the street said he had seen Paul around that time outside, late at night, with another man digging something doing something in the backyard in the dark for five hours and not only did he see that . They were pouring concrete and he actually claims that he saw them dig a hole that was four feet wide and seven to eight feet long and then they dropped something that to him looked like a rug, a rolled up rug, he said it definitely looked like something. The inside was heavy because it took them both to move it.
He watched them put dirt back on it and then pour concrete on top of it and since then they have built a garage on top of this place and this garage actually blocks access from the backyard to the driveway, so after Mary and Joe They moved out of the house, Susan actually just moved back in, she obviously won't let another tenant in and once people found out she was back in the house, tons of people would drive by all the time and honk. People take pictures, even knock on the door to try to get information out of her, but through it all, Susan has never left and you have to wonder why.
So the FBI considers Kristen's case a high-priority missing persons investigation. They have offered a reward of 75,000. To obtain information that could lead to finding her or solving her case, in early 1999 the police went and interviewed over a thousand Cal Poly students and also did another physical search of the campus, but no They found no new evidence in 2000. The FBI and the sheriff's department reviewed the case and decided that it was very possible that Kristen's body was buried in Susan's house, so on June 19 of that year they served a search warrant. at his home and investigators searched his house for nine hours and this time they used more advanced ground penetrating radar hoping to find new evidence and because they had this advanced technology apparently they didn't need to dig up the concrete and his family really hoped that something would come of this, but the results were inconclusive. and as soon as they left his property the warrant expired so there's another very important person on Kristen's case and that's Dennis Mann and he's actually a citizen detective like he volunteered and started following Kristen's case late from the '90s and there's a really good one.
I interviewed him on his own backyard podcast and he was introduced to Kristin's family and he's been a big part of the case and part of his efforts to get justice for Kristin ever since, while working on Kristin's case, she ended up talking to one. of the main investigators of the case and asked him why Susan's yard was never dug up and this investigator supposedly told him that it was because the group of investigators took a vote and they all decided that it was not worth it because if they did not find anything and they would damage the Specifically, it would be too expensive to repair, of course, Kristen's family was very upset to hear this and when Dennis went public with this information, the police basically said it was all lies, they denied saying it and said it was simply because they couldn't authorize the excavation, the strange thing about this case is that the question of cost seems to keep coming up as an excuse for the researchers even though the community has offered tons of funds and also volunteer services, people have been willing to volunteer to free members.
Community members have even volunteered equipment and things, it just doesn't make any sense. Dennis felt that the only way they would really make progress on the case was if he himself started trying to talk to the Flores family, which you know he does. I don't always recommend it but hey you have to give him credit for being bold about it because the police weren't doing it and he would just go to their house and try to talk to them, at one point he had even tried to talk to paul and paul started to answer him and then his parents quickly took him home.
At one point, Susan was arrested for attacking him outside her house, and according to Dennis, she actually said yes. Paul killed Kristen and also killed that Modafury girl after that.He realized that he could take pictures of the family as long as he wasn't standing on their property when he took the photos, they could take pictures of him too, so they started taking pictures of each other. The Flores family was very irritated with him. and they finally got a restraining order against him and it was actually enforced and he didn't really care he just violated the restraining order anyway and they called the police once and arrested him and then he got this in August of 2005. the The Flores family actually files a lawsuit against the Smart Family in which they claim that Dennis was working on their behalf, so they were responsible for all the bullying and harassment they had been going through with Dennis.
They tried to say that they were legally and financially. responsible for the anguish they had gone through being harassed by dennis, we have been harassed, we have had a restraining order, we have imprisoned Mr. and Mrs. Smart's henchman for harassing and harassing us and when I say we I mean ruben and I I mean Mike, my daughter, her husband, my son, we were all protected by the restraining order, he violated the restraining order, he went to jail and like I said, he was her henchman, but it's a joke to her because with With this new demand came a new opportunity to unearth. more information about the case the flores family property could be searched again now because they had to prove that dennis had a reason to be there and luckily the lawyers were able to negotiate the terms of the search without the police department being involved so In March 2007, a leading ground-penetrating radar expert was hired to search his property, but he was unable to obtain a reading of the planters and the newly built garage because he was unable to search the area where the dog cadaver had ascended.
He was allowed to see the rest of the yard, but not that area specifically, which is obviously very frustrating. An excavation team was able to dig into this location, get some of the concrete out and test it, and they somehow ruled it out as a potential burial site, but this team was not allowed to dig into the flower pot, which is where it would likely be. during all this time. The smart family was very frustrated but they never lost hope. Kristen was declared legally dead in May 2002 and her family. was starting to worry that people were forgetting about her, there was just a lot less media, people didn't talk about her as much in the years that followed, they asked the public for donations to keep the billboards in the area, which can It's really expensive, but you can really keep someone's name on there, which is very valuable.
In 2011, everything changed. There was a newly elected sheriff named Ian Parkinson, who took charge of the case and ordered a complete review of all the evidence he claimed was involved. to find answers for the smart family and so they felt hopeful for the first time in a long time, but things moved painfully slowly, I mean, it wasn't until September 6, 2016 that the sheriff's department announced that they were investigating a new clue they had launched. Another campus search with cadaver dogs and bulldozers this time, so it was going to be a big deal. In fact, I remember it happening.
They spent four days excavating these areas around campus and the case was finally starting to move forward for the first time. in 20 years and that's when I first heard about it because of that progress and just from what I researched about it I felt like things were going to move a lot faster, it seemed like there was a lot of evidence about Paul, I mean that's definitely What I took away from this when I covered it years ago and when this search took place, it seemed like there was a renewed sense of urgency to find out what had really happened to Kristin and then in 2019, something huge for someone's case happened what i didn't expect chris lambert he's a musician decided to do this podcast and he was really worried about

kristin

and he wanted to find her he said almost as much as his family did so he launched the podcast in his own backyard and it included a lot of new information and really compelling interviews he said that i was motivated to do this podcast after passing kristin's billboards over and over again and just wondering what happened and this podcast did really well, it gave the case a new spotlight, i mean they had barely been getting any coverage.
I remember when I covered it it was one of the first times they covered it in a long time and they were very happy to receive coverage from my little YouTube channel at the time, so when this was completely dedicated and professionally done wonderfully. When the finished podcast was released, they were ecstatic, so when the case made the news again, they thought the E Floors family was probably talking about it among themselves, possibly on their devices, so in 2019 they got a court order to monitor Paul's cell phone and this podcast made a big difference as the police learned things about the case that they didn't even know, they ended up going and interviewing people that he had on the podcast that they had never interviewed before they found a person on the podcast and they will interview them.
He was an Australian exchange student named Neil Van Est. His story had been thrown out for some reason by detectives years before, but with fresh eyes he ended up being a big part of the entire case. The night Kristen disappeared, he was riding his bike back from the library. very late at night, around 2am. m., and actually saw a man and a woman inside the Sierra Madre living room, which is Cheryl's bedroom, and they were fighting and fighting, it seemed like the woman was trying to escape and she described this man as being about the average height of he. about 510 and the woman a few inches taller, about six feet, just like Paul and Kristen, said the light was on in the lobby area, you can see where they would be standing and she had a clear view across the floor , for -roof windows on the front of the building, so now the case was really starting to take shape, a picture is finally being painted after all these years of what may have happened that night and then, in January 2020, police announced that they had actually recovered both. of the Flores family's trucks that they had tried to get rid of the Nissan and the Ford Ranger, so we don't know what may have been found in the trucks at this time and then in February, police executed four search warrants in California and washington. been to the houses of paul reuben susan and her sister irma linda and we don't know exactly what was found but they said that items of interest were found in april some new evidence we don't know exactly what it is there are still a lot of things we don't know at this time, but this new evidence led to a second search warrant for Paul's home in San Pedro, California, and investigators said they were looking for specific items of evidence and during this search they ended up bringing in a bunch of electronic devices as evidence , including cell towers, cell phones and other electronic devices, some of them decades old and this time Paul was detained but was released shortly after, recently in March 2021 a search warrant was issued for the house of Reuben and the researchers.
They used cadaver dogs and ground-penetrating radar to search the entire property and also took one of their cars, a Volkswagen, as evidence, and at the moment not much information has been released to the public, especially about what they found. . and that's all for a reason, hopefully, but finally I guess they had enough to make

arrests

in the case. On April 13, 2021, police arrested Paul Flores, 44, and his father, Ruben Flores, 80 , in each of their houses and this was super exciting. to see this finally happen after all this time paul was charged with first degree murder and held without bail finally now investigators have come forward and said they believe paul killed kristen in some kind of attempt to sexual assault or rape and then they believe that Reuben helped him hide her body and they said that based on biological evidence, they believe that Kristen's body was actually first in Reuben's house under his terrace, so not in the Susan's house, which still needs to be searched, and they think that if her remains were there, they were recently moved the statute of limitations has expired when it comes to sexual assault, but murder committed in the course of rape or attempted rape would be justified as a first degree felony so the statute of limitations does not apply to Ruben he was charged with being an accessory after the fact and he was released on bail and what's really cool is that when the sheriff announced This arrest they credited Chris Lambert for his amazing podcast and all the amazing interviews he did in 2019, we interviewed several witnesses who had not been interviewed previously.
Uh, and I will say that some of that information came to light through the podcast that many of you know and that was produced and ultimately led to us interviewing that witness. They also said they believed Paul had committed several sexual assaults over the years and if anyone has more information about Paul, please call him. If for some reason he knows something, I will have that information below while they are working to build the best possible case against him at this time and it would be a great help. Paul has already been charged with three other assaults dating back to January 2007.
So clearly Kristen wasn't the last, most recently on April 19, Paul and Reuben pleaded not guilty after the arrests were made. The Smart family filed their own lawsuit against Ruben Flores for intentionally causing emotional distress over the past 25 years. You have caused this distress by hiding Kristin's body, preventing them from giving her a proper burial all this time. The lawsuit alleges that Kristen's body was buried under her deck and that after police searched her property in February 2020, he and two other people, Susan Flores and her boyfriend, Mike McConville, moved her body to another location. and it also says that susan and mike will be added as defendants at a later date, so clearly there is more evidence that kristen was buried under cover than we know at this time and we have also learned that a confidential witness who police say it is credible he has claimed to have seen them move the body, whoever it is, and more information about it is being withheld from the public this time the smarts are also suing for an unspecified amount of damages that exceeds 25,000 and The first hearing is scheduled for August 2021.
This has been a long and painful road for the smart family, of course, they are very happy to finally have movement now. but it has taken too long. One positive thing that has come out of this case is the Kristin Smart Campus Safety Act and this law requires campus police to immediately report potential violent crimes or missing persons cases involving students to the local police force and this came in It came into effect on January 1, 1999, but since Sheriff Parkinson took over the case, much more has been done. Investigators executed more than 41 search warrants and that included 16 physical searches at different locations.
They also presented 37 different pieces of evidence that were out there. from the early days to be tested with modern DNA technology and not only that, they also found 193 new items of physical evidence, conducted 137 in-person interviews, and completed over 500 additional police reports, so there's a ton being made on this moment. It has been done and I hope that in the end everything will bear fruit. I hope so. I have faith that this family will truly see justice, but obviously there are still many unanswered questions. I know you guys want to know more about Susan and this. Guy Mike more about ownership of it and what has and hasn't been done.
I also have many questions. We're just not going to get the answers right now, but hopefully all this new information, new witness testimony, new evidence, all the clues. to a really solid case and hopefully they can finally get justice for Kristen's family as right now they don't have Kristen's body but Sheriff Parkinson has promised Kristin's family that one day he will find her and bring her back home, obviously there will be more news about this case. I'll post any important updates on my Twitter, which is Kendall Ray on YouTube, and I hope one day I can make another good update on this case and we'll see things move even further.
I am beyond happy that the smart family is finally seeing this happen. I was just afraid that it had been too long for a while. I felt like so much time had passed and nothing was being done and there were so many dead ends and lack of information I really felt like this day would never come. SeePaul Flores handcuffed outside in those photos was so satisfying I can't imagine how his family felt. There is something about Kristin's case that will always stay with me. Maybe it's something. to do with the fact that it could have been me, you know, I was that drunk college student walking around campus not too long ago and I know what it's like to be out of control in those first few years of school when you're just trying to live life and try the real world and you can end up in such a scary situation so quickly it could have been me, it could have been any of my friends, you know, there's something about this that's so disturbing and to be so obvious that it was paul This whole time was so infuriating that it's one of the things that really got me into troop crime because I thought, wow, how can there be such an obvious suspect and yet nothing happens and this guy just gets away with it because he He refuses to say anything, he is only claiming the fifth, so seeing this now is very satisfying and motivates me to continue working on other cases that have not obtained justice and that no one has talked about.
For a long time, I mean, seeing what Chris Lambert has done here with this podcast is really inspiring to me and makes me feel very proud of the true criminal community. There are some people who really care and are doing a lot of good. things right now and it's really great to see so much progress in several different cases that I've covered, so I hope this trend continues but of course I want to know your opinion on Kristen's case. I know you have ideas and remember there is still a lot we don't know so I hope to get more answers in the future but that will be it for me today.
I hope you enjoyed this video. If you want to check out Chris' podcast, be sure to check it out. It's free. and it's really really good and that's going to be it for me today guys, I hope you're all having a good day, stay safe and I'll see you next week.
